As is well known, cookies are as a rule strings of text that websites (so-called publishers, or “first parties”) visited by the user or different websites or web servers (so-called “third parties”) place and store - directly, in the case of publishers, and indirectly, i.e. through them, in the case of “third parties” - within a terminal device in the availability of the user.
The terminals referred to are, for example, a computer, tablet, smartphone, or any other device capable of storing information. Already today, and even more so in the future, these include so-called IoT (Internet of Things, or Internet of Things) devices, which are designed to connect to the network and to each other to provide services of various kinds, not necessarily limited to mere communication. Software for browsing the Internet and operating these devices, e.g., browsers, can store cookies and then transmit them back to the sites that generated them on a subsequent visit by the same user, thus maintaining memory of his or her previous interaction with one or more websites. The information encoded in cookies can include personal data, such as an IP address, user name, unique identifier, or e-mail address, but it can also contain non-personal data, such as language settings or information about the type of device a person is using to browse the site. Cookies can therefore perform important and diverse functions, including tracking sessions, storing information about specific configurations regarding users accessing the server, facilitating the enjoyment of online content etc. They can, for example, be used to keep track of items in an online shopping cart or information used to fill out a computer form. While it is through cookies that it is possible to allow, among other things, web pages to load faster, as well as to route information over a network - in line, therefore, with fulfillments strictly related to the very operation of websites -, again through cookies it is also possible to convey behavioral advertising (so-called “behavioral advertising”) and then measure the effectiveness of the advertising message, i.e., to conform type and mode of services rendered to the user behavior subject to previous observation.
Since it is not possible to distinguish cookies on the basis of their technical characteristics, they can be subdivided as explained below.
The main subdivisions concern the origin, according to which they are identified:
- first-party cookies, which are installed directly by the operator of the site on the user's terminal;
- third-party cookies, which are installed by a different site through the operator of the site that the user is visiting;

The function pursued by cookies, whereby a distinction is made between:
- technical cookies which are those used for the sole purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide such service” (see Art. 122, para. 1 of Legislative Decree 196/03). Consent is not required for such cookies.
- profiling cookies which are those used to trace back to specific, identified or identifiable subjects specific actions or recurring behavioral patterns in the use of the offered functionalities (pattern) in order to group the different profiles within homogeneous clusters of different width, so that it is also possible for the owner, among other things, to modulate the provision of the service in an increasingly personalized manner beyond what is strictly necessary for the provision of the service, as well as to send targeted advertising messages, i.e. in line with the preferences expressed by the user in the context of web browsing. These cookies can only be used with the consent of the interested party, which is also the legal basis of the processing. The User can never be obliged, without alternative, to express his or her consent to the reception of such cookies, under penalty of not being able to access the site.
- analitycs cookies that carry out analysis and statistics on site usage and navigator flow. In the site in question they are subject to consent, which is the legal basis for processing. The User can never be obliged, without alternative, to express consent to receive such cookies, under penalty of impossibility to access the site.
- Other tracking systems
There may also be other technologies through which the same purposes pursued with Cookies are pursued.
For example, although Cookies can be used in both web and mobile browsers, it would be inappropriate to talk about Cookies in the context of mobile applications, since these are Tracking Tools that require the presence of a browser. For this reason, within this document the term Cookie is used only to refer specifically to that particular type of Tracking Tool. The same criteria used for cookies apply to these technologies.
- Coding criteria
The criteria by which tracking tools (thus including cookies) are placed under predefined categories are shown below.
Functional– are always active except for the right for the user to block them through the settings of their browser. They are used to ensure the proper functioning of the site and for the sole purpose of carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service to provide a service explicitly requested by the contractor or user. Their use does not require the user's consent. Without such cookies, the site may not function properly or functions (e.g. shopping cart) may not be active . The legal basis of processing for such cookies is the legitimate interest of making the site work properly. They are included among the technical cookies.
Statistical Cookies –
Statistical Cookies are used to understand how visitors interact with sites by collecting and reporting information anonymously.
